In accordance with Article 76, the President designates an individual to serve as the Attorney General of India who meets the requirements to serve as an Apex Court judge. Senior advocate R. Venkataramani has been appointed as the new Attorney General of India.
He serves at the pleasure of the President and is the first legal official of the Government of India.
Appointment Of Attorney General Of India
According to the convention, the Attorney General of India resigns when a new government is formed, and this government appoints a person of its choice as the new AGI.
Qualification of the AGI
His qualifications are the same as those required to be a judge of the Supreme Court.
On the advice of the government, the President appoints the Attorney General. He or she must be a citizen of India and must have served as a judge of a high court for five years, as an attorney of a high court for ten years, or as a prominent jurist, in the judgment of the President.
Salary of the Attorney General Of India
The AGI receives a “retainer,” which is periodically chosen by the President, rather than a salary. His retainer is currently equivalent to the Supreme Court judge’s salary.
Because his employment is contractual in nature, he receives a retainer rather than a salary, which enables him to maintain his own practice.
He is neither a full-time government attorney nor a government employee.
There are two solicitors general and four additional solicitors general to support AGI.
Duties Of AGI
The AGI advises the President on legal matters and performs such legal functions as mentioned in the Constitution or assigned to him from time to time by the President.
He is the official advocate of the Government of India and defends the Union Government in Supreme Court or High Court in those cases in which the Government of India is a part.
In any civil case, he can’t give any briefing or advice to any person against the Government of India, neither he can defend that person against the Government of India because he is supposed to defend the Government of India.
However, in a Criminal Case with the prior permission of the President, he can defend any accused person.
As long as he is AGI he can’t be appointed as a Director in any Company.
Powers of Attorney General
The AG can approve the brief but is unable to appear against the government.
You cannot defend an accused in criminal proceedings and recognize the management of a company without the permission of the government.
The AG will be consulted only in legal matters of special value and only after consultation with the Law Ministry.
The Law Ministry makes all references to the AG.
Privileges Of AGI
The AGI has the right to an audience in any court throughout the territory of India including ‘in-camera’ proceedings.
He is not a member of either house of the Parliament; however, he has the right to attend sessions of the Parliament and speak in it, participating in debates but without having any right to vote in the Parliament. He has all the privileges and prerogatives enjoyed by MPs.
