On March 8, on the occasion of International Women’s Day, the Protection of Children from Sexual Offences Act, 2012, the Kailash Satyarthi Children’s Foundation (KSCF) has released a study report.
This study report has revealed the fact that the implementation of POCSO law in India is not being done adequately.
The key findings of the KSCF study in the context of the POCSO Act
- Following points in the context of the implementation of POCSO-act by the Kailash Satyarthi Children’s Foundation (KSCF) –
- Approximately 3000 cases of sexual abuse each year reach the court, with 99% In this case, the victims of sexual abuse are girls. The main reason for this is that due to a lack of sufficient evidence and clues, the investigation of these cases by the police is stopped before the charge sheet is filed in court.
- Despite the increase in sexual offences in recent years, the number of pocso-act cases closed by police has increased in 2017 to 2019.
- Every four victims of child sexual abuse in the country were denied justice because those cases were closed by the police due to lack of sufficient evidence.
- According to NCRB data, in most of the cases that have been closed or dealt with by the police, the reason for closing the case is that ‘the cases are true, but there is insufficient evidence. According to the data, in the year 2019, 43% of the cases were closed by the police on the same basis, which is more than the cases closed in comparison to 2017 and 2018.
- The study also revealed the fact that “false complaints” have been the second most important reason for closure of cases related to pocso. Although such cases have decreased in the year 2019 as compared to previous years.
- Along with this, the study done by the Foundation has also revealed that the courts are also taking a lot of time injustice. It is worth mentioning that as per the updated data for the year 2019, about 89% of the victims of child abuse cases are awaiting justice in court.
- Along with this, the study done by the Foundation has also revealed that more than half of the cases of pocso-act were reported in about 51% of the five states. These states are Madhya Pradesh, Maharashtra, Uttar Pradesh, Haryana and Delhi.
Regarding the Protection of Children from Sexual Offenses Act (POCSO) 2012
- POCSO Act, 2012, was introduced to provide protection to children from sexual offences, sexual exploitation and pornography. It aims to protect the interests of children and ensure their welfare. Under the Act, a child is defined as a person under the age of 18 years of age and ensures the physical, mental and social development of the child by giving the highest priority to the interests and welfare of the child at all levels. This law is based on gender equality. The Cabinet has amended the Child Sexual Offenses Protection Act 2012 (POCSO) in 2019 to provide protection to children from sexual offences and has given strict punitive provision including the death penalty for sexual offences.
